Welcome to NOVACRED, TOMIANDFUREE (“TOMIANDFUREE”, “we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of our APIs, developer interface, website, dashboards, documentation, and related systems (collectively, the “TomiAndFuree”).

By accessing or using the TomiAndFuree, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the TomiAndFuree.

1. Acceptance of Terms

By signing up, connecting to, integrating, or otherwise using the TomiAndFuree, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms form a legally binding agreement between you and Novacred.

2. Permitted Use

• Purpose: You may use the TomiAndFuree only for authorized business purposes in accordance with your agreement and applicable laws.
• Compliance: Your use must comply with all applicable local and international laws and regulations.

3. Prohibited Use

You shall not:

• Reverse engineer, copy, sell, sublicense, or exploit the TomiAndFuree.
• Upload, publish, share, or disseminate unlawful, harmful, infringing, or offensive content.
• Send unsolicited communications, spam, malware, or manipulate system behavior.
• Use the service in any manner that violates applicable laws or regulations.

4. User Data & Privacy

• User Authority: You represent that you have the right to submit and process all data provided through the TomiAndFuree.
• Data Use: All data will be handled in accordance with the TomiAndFuree Privacy Policy.
• Retention & Access: You are responsible for the legality, accuracy, and integrity of your data.

5. Disclaimers

TomiAndFuree services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted, error-free operation or suitability for specific requirements.

6. Limitation of Liability

To the fullest extent permitted by law, Novacred shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of data or profits. Novacred’s total liability shall not exceed INR 500 (Five Hundred).

7. Indemnification

You agree to indemnify and hold harmless Novacred, its directors, officers, employees, and affiliates from any claims or liabilities arising from your use of TomiAndFuree or violation of these Terms.

8. Termination

Novacred may suspend or terminate your access at any time for violation of these Terms. Upon termination, all rights granted to you will immediately cease.

9. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996. Arbitration shall be conducted in English and seated in Pune, Maharashtra.

10. Changes to Terms

Novacred reserves the right to update or modify these Terms at any time. Updated policies will be published on the Novacred website with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
